Licensing

This is an End User License Agreement (EULA) between the end user (You) and DIY Craft Tutorials Pty Ltd. By downloading the licensed product (such as our design and graphics) you are agreeing to the terms of this license, as set out in this license.

This standard License is valid for one (1) person on an unlimited number of computers or devices operated by that one (1) person. If more than one (1) person in your company or household will be using our products, each person must purchase a separate license.

This standard License covers the licensee (You) for their lifetime, and all purchased items covered under this license may be downloaded to any of the licensee’s computers or devices at any time in the future. It is your responsibility to read this Agreement carefully and understand its contents.

DIY Craft Tutorials Pty Ltd may from time-to-time revise, update or modify this End User License Agreement with or without notice to You and further reserves the right to make formatting, edits and changes to the manner of any content hereunder.

LICENSE SUMMARY

Allowed:

Personal and Small Commercial Use.

 Creating an unlimited number of finished physical end use products to give away or sell (including but not limited to: keychains, paper flowers, signs, clothing, drinkware, stickers, etc).

 

Not Allowed:

X Distributing digital files in any manner, including but not limited to: selling, giving away for free, sharing with friends or a group, including as part of a package of products or new digital product to any other person or company.
Sending graphics or design products to any outside printer, maker, manufacturer, print-on-demand company, or any other party, so that the outside party can make physical end products on your behalf.
Selling on sites such as Amazon or eBay, where the other party fulfil your orders for you.
Digital designs and finished physical products cannot be re-sold by your customers. Your customers cannot re-sell the products you create.
Reselling to your customers as part of a kit for them to put together. You can only sell the pre-assembled finished product.
Creating transfers (including, but not limited to: sublimation transfers, waterslides, screen print transfers, HTV iron-on transfers and decal transfers).
Replicating, recreating, modifying, tracing, sub-licensing the designs in part or in whole and redistributing as your own work.
Manufacturing or mass-producing items using the design in part or whole.
X Converting or digitizing designs for fabric printing, embroidery/cross stitch patterns, gift wrap, scrapbooking paper, sheet vinyl or any cloth materials.
Creating stencils, stamps, colouring books and other similar items including, but not limited to: metal dies and molds.
 

FULL LICENSE TERMS

PERSONAL USE
Personal use is defined as using designs for your own personal use. Designs may be used for personal projects made for yourself, family members and friends.

 

SMALL COMMERCIAL USE
Commercial use is defined as using designs for commercial purposes or monetary gain. This includes selling items made from our designs.
 
Allowed:
✓ Creating an unlimited number of finished physical end use products to give away or sell (including but not limited to: keychains, paper flowers, signs, clothing, drinkware, stickers, etc).

Not Allowed:
Distributing digital files in any manner, including but not limited to: selling, giving away for free, sharing with a design collective or group, sharing with friends, or including as part of a package of products or new digital product to any other person, company, or party.
X Designs may not be replicated, recreated, modified, traced, rented out, sub-licensed in part or in whole, and redistributed as your own work. The copyright remains the property of DIY Craft Tutorials Pty Ltd.
X Designs and finished products cannot be re-sold by your customers. The commercial license covers the licensee only. Your customers cannot re-sell the items you create. They will need to purchase a license from DIY Craft Tutorials Pty Ltd if they wish to use our designs for commercial purposes.
X Designs may not be repackaged on their own or with your own designs and redistributed for free or for sale. Examples would be making your own paper flower kits for sale (cut the template out on cardstock and then sell it as a kit with instructions for your customer to assemble) or selling the design files as your own template/kit. You can only sell the pre-assembled finished end product.
X Creating transfers (including, but not limited to: sublimation transfers, waterslides, screen print transfers, HTV iron-on transfers and decal transfers).

X Designs may not be used as a logo for your business, in a logo design or part of a trademark.
X Designs may not be used to infringe upon any patent, trademark, trade secret, copyright or other proprietary rights of any party or rights of publicity or privacy.
X Designs may not be used for unlawful use. You may not use content in a pornographic, defamatory or other unlawful manner.
X Future Technologies: The license is limited to the permitted uses stated in this License Agreement: future technologies and uses are reserved and not included within the scope of the license.
 

FREEBIES

All of the free designs offered by DIY Craft Tutorials Pty Ltd are intended for personal use only.

Not Allowed:
Commercial use in any way. Creating physical or digital products from the free design with an intent to sell to make a profit or receive monetary gain is strictly prohibited.
Distributing digital files in any manner, including but not limited to: selling, giving away for free, sharing with a design collective or group, sharing with friends, or including as part of a package of products or new digital product to any other person, company, or party.
If a violation is found, will we take all necessary measures as the owner of the intellectual property.
 

ADDITIONAL INFORMATION

SELLING – WITH OUR DESIGNS
Our digital design images/files cannot be added to an image catalogue of available designs, which your customer can choose from or to be used within a digital mocked up photo.
However, you can show photos of your PHYSICAL products with the final designs on them.
 
We also recommend watermarking over images of your product in a way that makes tracing/image stealing difficult.
 
EXTENDED LICENSING
If your usage may fall outside of the terms of this agreement in a commercial capacity, please contact us for tailored licensing.
 
COPYRIGHT

LICENSE RIGHTS
All designs are licensed, not sold. When purchasing a file, you are granted the non-exclusive, non-transferable, single-user license with rights to use the designs as defined in this license. All rights are reserved by DIY Craft Tutorials Pty Ltd.
Our system checks the usage of our images/designs regularly and we may ask you to provide us with your order number for you to be able to prove that you have bought a license from us for each design used. Please keep your receipt for future reference.
 
TERMINATION
DIY Craft Tutorials Pty Ltd may terminate this License Agreement at any time if the Licensee breaches any of the terms of this, or any other agreement with DIY Craft Tutorials Pty Ltd - in which case the Licensee must immediately: cease using the Licensed Asset; delete or destroy any copies; and, if requested, confirm to DIY Craft Tutorials Pty Ltd in writing that Licensee has complied with these requirements.
If the Licensee uses the Licensed Asset on a social media platform, or any other third-party website and the platform or website uses (or announces that it plans to use) the Licensed Asset for its own purpose - or in a way that is contrary to this License Agreement, the rights granted for such use shall immediately terminate, and in that event, the Licensee agrees to remove any content from such platform or website.
 
AUDIT
Upon reasonable notice, Licensee agrees to provide to DIY Craft Tutorials Pty Ltd sample copies of projects or end uses that contain Licensed Asset, including by providing DIY Craft Tutorials Pty Ltd with free of charge access to any pay-walled or otherwise restricted access website or platform where the Licensed Asset is reproduced. In addition, upon reasonable notice, DIY Craft Tutorials Pty Ltd may, at its discretion, either through its own employees or through a third party, audit Licensee’s records directly related to this License Agreement and Licensee’s use of the Licensed Asset in order to verify compliance with the payment and other terms of this License Agreement. If any audit reveals an underpayment by Licensee to DIY Craft Tutorials Pty Ltd of five percent (5%) or more of the amount Licensee should have paid, then in addition to paying DIY Craft Tutorials Pty Ltd the amount of the underpayment and any other remedies to which DIY Craft Tutorials Pty Ltd is entitled, you also agree to reimburse DIY Craft Tutorials Pty Ltd for the costs of conducting the audit.
 
GOVERNING LAW
This License shall be governed by, and construed in accordance with, Australian law; and the Australian courts shall have exclusive jurisdiction to determine all disputes in relation to it except as listed in this License. You agree that if You default in your obligations hereunder, damages alone would not be an adequate remedy, and an order for specific damages and no proof of special damages shall be necessary for the enforcement of its obligations hereunder.

You agree that any dispute arising out of or in connection with this contract shall, at first instance, be referred to a mediator for resolution. The parties shall attempt to agree upon the appointment of a mediator, upon receipt, by either of them, of a written notice to concur in such appointment. The seat of the arbitration shall be Australia, and the location to be determined by DIY Craft Tutorials Pty Ltd. All proceedings and documents shall be in English.
 
TERMS, INDEMNIFICATION AND DISCLAIMER
You agree to defend, indemnify and hold harmless DIY Craft Tutorials Pty Ltd and its directors, employees, partners and affiliates from and against all allegations, suits, claims, actions, demands, damages, liabilities, obligations, losses, settlements, judgments, costs and expenses (including without limitation reasonable attorneys' fees and costs) which arise out of using any of the products obtained from this site.
In no event will DIY Craft Tutorials Pty Ltd, or its affiliates, service providers, employees, agents, officers or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with this license agreement, including, without limitation, your use, or inability to use, the licensed asset, including any indirect, special, incidental, consequential or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), intellectual property infringement, breach of contract or otherwise, even if foreseeable.
It is your responsibility to make sure that you familiarize yourself with the consumer product safety guidelines for your country before making any products for personal or commercial use and make sure those items comply with the country’s safety guidelines and regulations. Use products and materials mentioned at your own risk.
DIY Craft Tutorials Pty Ltd shall not be liable for any direct, incidental, consequential, indirect or punitive damages arising out of access to or use of any content available.
